Kristi Noem, Secretary of Homeland Security v. Svitlana Doe, No. 24A1079. On May 30, 2025, the Supreme Court granted the government’s application for a stay. The April 15, 2025 order of the District of Massachusetts in No. 1:25-cv-10495 is stayed pending disposition of the First Circuit appeal and of a timely petition for a writ of certiorari. If certiorari is denied, the stay terminates automatically.

The Court’s docket records the application as presented to Justice Jackson and referred to the Court. Justice Jackson, joined by Justice Sotomayor, dissented from the grant. A stay is not a merits opinion on the parole statute. It is not a finding that the district court committed a crime. It is the Supreme Court putting her April order on hold.
