Planned Parenthood Federation of America, Inc. v. Kennedy (D. Mass.). Congress enacted Section 71113 of An Act to provide for reconciliation pursuant to title II of H. Con. Res. 14, Pub. L. No. 119-21, 139 Stat. 72, 300–01 (July 4, 2025). The provision withholds Medicaid funding for one year from entities meeting statutory criteria. Plaintiffs challenged it as a bill of attainder, a First Amendment retaliation, and an equal-protection violation.

On July 21, 2025, Talwani granted in part the emergency motion for a preliminary injunction (Doc. 4). Her later August 11 electronic order restates what that July 21 memorandum did: it enjoined enforcement of Section 71113 against Planned Parenthood Association of Utah and other Planned Parenthood Federation members who would not provide abortion services as of October 1, 2025, or for whom fiscal-year 2023 Medicaid expenditures made directly to them did not exceed $800,000. She denied a stay pending appeal. A partial preliminary injunction is not a final judgment. The First Circuit later vacated it.
