One week after the partial order, Talwani granted the emergency motion in full. The July 28, 2025 memorandum and order (Doc. 69) enjoined defendants from enforcing Section 71113 against Planned Parenthood Association of Utah, Planned Parenthood League of Massachusetts, and all other Planned Parenthood Federation of America members. She again denied a stay pending appeal. Defendants noticed an appeal on August 5, 2025.

The July 28 opinion, as quoted in contemporaneous reporting and later by the First Circuit, treated Section 71113 as a targeted exclusion. A nationwide preliminary injunction against a statute is still a preliminary injunction. It is not a Supreme Court holding. The First Circuit vacated both the July 21 and July 28 orders on December 12, 2025.
