Newsmax (Dec. 3, 2025) and National Review (Dec. 2025) report that on December 2, 2025, Talwani issued a preliminary injunction in a lawsuit by Democratic-led states challenging Section 71113, on a Spending Clause / clear-notice theory, after the First Circuit had already stayed or was reviewing the Planned Parenthood Federation injunctions. Newsmax describes a halt on enforcement in 22 states. National Review describes 22 blue states and a Tuesday filing.

The Washington Examiner (Dec. 31, 2025) later reported that a First Circuit panel stayed and then overturned that states-case ruling, the second time an appeals panel sided with the government on the same statute. Those articles are not the order. A preliminary injunction is not a conviction. Do not write IMPEACHED from this episode.
