The Court granted the government’s application and stayed the injunction entered in District of Massachusetts No. 1:26-cv-11581 pending the First Circuit appeal and disposition of a timely certiorari petition. Application 26A139 (intervenor states) was denied as moot. Justice Sotomayor, joined by Justice Kagan, dissented. Justice Jackson dissented separately.
The Court wrote that the executive order itself does not harm the States, so the district court lacked jurisdiction to bar the government from trying to implement it. It also wrote that the stay “does not mean that any measure taken by the Government to implement the Order will necessarily be lawful.” That sentence is the Court’s. A stay of the California injunction is not, on its face, a vacatur of the August 11 League of Women Voters preliminary injunction in No. 1:26-cv-11549.
